"A federal appeals court is hearing arguments concerning the sentence of death row inmate Mumia Abu-Jamal (moo-MEE’-ah AH’-boo jah-MAHL’).
Hundreds of Abu-Jamal supporters gathered outside the federal courthouse in Philadelphia as the 3rd U.S. Circuit Court of Appeals heard arguments Tuesday over instructions given during his 1982 trial.
The U.S. Supreme Court this year ordered the court to reconsider its decision granting Abu-Jamal a new sentencing hearing in the 1981 shooting death of Philadelphia police officer Daniel Faulkner..."

PHILADELPHIA — The Supreme Court on Tuesday threw out a ruling that had set aside the death sentence of Mumia Abu-Jamal, convicted of killing a Philadelphia police officer in a racially tinged case that has made the former Black Panther an international cause celebre.www.freedom-now.de
The justices ordered the 3rd U.S. Circuit Court of Appeals in Philadelphia to revisit its 2008 ruling that Abu-Jamal deserved a new sentencing hearing because of flawed jury instructions at his 1982 trial. The Supreme Court pointed to its ruling in an Ohio case last week, when it said a neo-Nazi killer did not deserve a new sentencing hearing on those grounds.
Prosecutors called the Ohio case directly on point.
“The order pretty much says it all,” Philadelphia Assistant District Attorney Hugh J. Burns Jr. said. “I don’t see how you can possibly distinguish them.”
But Abu-Jamal’s lawyer insists the facts differ.
“If our cases are similar, of course it doesn’t bode well. But they’re different,” said lead appellate lawyer Robert R. Bryan of San Francisco. “It’s always uphill with a death-penalty case.”
The 3rd Circuit could still order a federal trial court to consider Abu-Jamal’s case anew on other still-pending defense claims.
A mostly white Philadelphia jury convicted Abu-Jamal of killing white Officer Daniel Faulkner in 1981 after the patrolman pulled over Abu-Jamal’s brother in an overnight traffic stop..."

Let me be very candid and straight to the point.
This is not a post-racial America.
This broken system of America is a joke to the fullest and could care less about giving justice to the Black people within its borders.
We were brought to these shores to be made into slaves and have since been treated as second class citizens. I think animals get better treatment, more advocacy and justice in this country than we do.
The evidence dates back to when we first arrived here in 1555, but I'm going to touch on what just happened a few days ago on November 5, 2010...."

"The only legal options to be considered at the Third Circuit's November 9 hearing are whether Mumia Abu-Jamal is to be executed or get life in prison without parole. Clearly neither of those two options is acceptable.
"Of course if the Third Circuit rules against Mumia, he will appeal to the Supreme Court. However, the odds for relief are small, given the increasingly reactionary nature of that court.Thus, Mumia's legal situation is extremely dangerous. His life truly is on the line, for no matter how the court rules, the only two choices under this legal system are either execution or life in prison without parole and, for the moment, the prosecution, with all its allies and backers, is fighting very hard for execution."
